Nonassertive Conduct refers to actions, behaviors, or gestures that are not intended by the actor to communicate or assert the matter to be proven. This type of conduct is not considered hearsay because the actor does not intend to make a statement or assertion, and therefore, the reliability of the evidence is not dependent on the credibility of the actor.
