## Definition

Prior Identification is a statement made by a witness identifying a person after perceiving them, which is admissible as non-hearsay evidence if the witness testifies at a trial or hearing and is subject to cross-examination concerning the statement. This rule allows for the admission of identification statements made by a witness during or shortly after observing the person in question, including statements made while identifying the person in a photo or lineup.
