Definition
A fee simple subject to a condition subsequent is a type of freehold estate in real property that grants ownership rights to the holder, subject to a specified condition, with the potential for forfeiture if the condition is violated. Unlike fee simple determinable, this estate does not automatically revert to the grantor upon breach of the condition; instead, the grantor retains the right to re-enter and reclaim the property, but must take affirmative action to enforce this right.
