- Ordinarily, one who hires an independent contractor to do work is not liable for the acts or omissions of the independent contractor or its employees. However, if the hirer should recognize that the work is likely to create, during its progress, a peculiar/special risk of bodily harm to others unless special precautions are taken, then the hirer is liable for bodily harm caused to employees for the failure of the independent contractor to exercise reasonable care to take such precautions.
